ELIGIBILITY FOR FAMILY-BASED IMMIGRATION
Eligibility for this type of immigration is based on the applicant’s relationship with the U.S. permanent resident or U.S. citizen. Immediate relatives include:
- The spouse of a U.S. citizen
- A U.S. citizen’s child, under the age of 21 and unmarried
- An orphan adopted from a foreign country by a U.S. citizen
- The parent of a U.S. citizen who is at least 21 years of age

ADJUSTMENT OF STATUS VERSES CONSULAR PROCESSING
You may qualify for an Adjustment of Status. The Immigration and Nationality Act allows an individual to change immigration status while in the United States to a Lawful Permanent Resident (LPR). Adjustment of Status can provide permanent residence without having to return to your home country.
Alternatively, consular processing allows individuals living outside of the United States (or those living within U.S. borders that are ineligible to adjust status) to obtain a visa while in another nation, then enter the United States as a permanent resident.
